Competition Rules

Please read the terms and conditions of the AFRICA PHOTOGRAPHY AWARDS (“APA”) carefully and pay special attention to all the terms printed in bold.

 

1.1       APA is organised by Q-PHOTO (PTY) LTD, Fujifilm South Africa (Pty) Ltd (“the Organizers”)

 

1.2       APA is open to any living, natural person, (e.g. anyone other than corporate bodies like companies, co‑operatives, partnerships, trusts, etc.) who –

 

1.2.1                is over the age of 18 as at the entry date;

1.2.2                is the sole owner of the images uploaded in the entry.

 

1.3         APA is not open to directors, shareholders, partners, employees or agents of or consultants to the Organisers, or their respective sponsorship agencies, their respective spouses, life partners, parents, children, brothers, sisters, business partners and associates, and any other person who directly or indirectly controls or is controlled by the Sponsor, or any supplier of goods or services in connection with APA. (XPhotographers are welcome to enter Africa Photo Awards as Fujifilm is not involved in the voting process) 

 

1.4       All Entrants agree that their participation in the APA is subject to these terms and conditions. Any decision by the Organisers regarding the interpretation or application of these terms and conditions in any dispute will be final and binding.

 

  1. AWARD WINNERS

 

2.1       The Main Award of Africa Photographer of the Year will receive:

Fujifilm X-S10 Camera Body with a Fujifilm XF18-55mm F2.8-4 R LM OIS Lens;

Printing voucher worth R 5 000;

Fujifilm Instax SQ20 Camera with 2 Packs of White Square film;

2.2       The 8 Category Award Winners, will receive:

Printing voucher R 2 000;

Fujifilm Instax Mini 11 Camera with 2 Packs of White Mini film;

2.3       The People’s Choice Award Winner will receive:

Printing voucher worth R 2 000;

Instax mini Link printer with 2 packs of film – value R4000.00;

 

2.4         The Organisers reserve the right at any time prior to any award to vary the prizes by giving reasonable prior notice by way of an E-mail to entrants. The Entrants will have no claim against Organisers in this event.

 

2.5         Prizes are not transferable and winners cannot exchange a prize for a cash amount.

 

2.6         The Sponsors will not be liable for taxes or any other costs incurred by winners in claiming or attempting to claim any prize, which shall include but not be limited to VISA, travel and accommodations costs associated in connection with the winner accepting her\his award. For the avoidance of doubt, it is understood that all such costs will be for the account of the Winner of the Award.

 

  1. HOW TO ENTER

 

3.1       To enter you must upload your image to africaphotoawards.co.za Images must not exceed 5MB in size and they must be saved in the RGB colour model and EXIF data must be left in the image file. Entrants must be able to supply a high-resolution image suitable for printing if required. Entrants shall make payment of the submission fee.

 

3.2       APA consists of the following categories:

 

3.2.1        Wedding

3.2.2        Portraiture

3.2.3        Wildlife

3.2.4        Land and Urban Scapes

3.2.5        Editorial

3.2.6        Abstract

3.2.7        Fashion

3.2.8       Conceptual

3.2.9        Fine Art

 

 

3.3       You may enter as many categories as you wish, however you cannot enter the same series or images into more than one category and a maximum of 5 images per category is allowed. You may highlight a single “signature image” from each series.

 

3.4       APA will commence on 04 May 2022 and conclude on 4 November 2022, therefore, all entries must be submitted by 11:59 on the 4 November 2022, in order for the Entrants to be considered. 2022 Entries extended to 31 January 2023.

 

3.5       The Entrants warrant that:

 

3.5.1                Entries do not contain any infringing, threatening, false, misleading, abusive, harassing, libellous, defamatory, vulgar, obscene, scandalous, inflammatory, pornographic or profane content;

3.5.2                Each Entry does not infringe upon the copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or violate any person’s rights of privacy or publicity;

3.5.3                The Entry does not include, trademarks owned by third parties, copyrighted materials owned by third parties (including movie dialogue or musical compositions)

3.5.4                The entry does not contain any commercial content that promotes any product;

3.5.5                Each person depicted in the Entry has granted permission to be portrayed as shown. Any costumes, props or other materials used must be rented or borrowed with the permission of the owner, and all other relevant permissions must have been obtained.

3.5.6                No animals were harmed or manipulated in the making of the image.

 

3.6       Entries will be judged by the panel of judges after the closing date. A shortlist of up to 10 photographers from each category will be selected and announced on the website prior to the final Award Winners being announced. The Shortlist entrants will also be notified via e-mail. The Judges will select a finalist in each category from which the Main Award winner will be selected the other remaining 8 category winners will each receive the prizes as identified in clause 2 above. The Organisers will advise the Award winners either electronically or alternatively the Organisers shall advise the finalist as to whether an Award Ceremony will be hosted wherein the Award Winners will be announced, the details regarding date, venue and time of the Award Ceremony shall be advised prior to the final Award Date.

 

3.7       The decision of the Africa Photo Awards Judging panel is final and no negotiations will be entered into.

3.8       The judges will judge a body of work, a maximum of 5 images may be submitted. Judging will be based on the portfolio of work entered for each category. The Organisers and the Judges reserve the right to remove any entry that does not comply with the following criteria as set out in these terms and conditions.

3.9       The Organisers may run an online rating process whereby people vote for their favourite photograph. Any manipulation of this process will result in disqualification.

3.10     The Entrants agree:

3.10.1 to participate in related publicity and to the use of Your name and likeness for the purposes of promotion and publicity without compensation;

3.10.2 and understand that any image submitted may be used by the Organisers and APA for publicity and creating awareness of the APA.

3.11   The Organisers acknowledge that all copyrights in and to the images remain with the Entrant that submitted the images, and the Organisers shall only utilise the images in accordance with clause 3.10.2.

3.12   The Organisers further confirm that all information collected by the Organisers in relation to Entrants shall be collected, distributed and stored in accordance with the necessary legislative and regulatory prescripts.

 

  1. ACCEPTANCE AND DELIVERY OF PRIZES

 

4.1         The Main Award Winner must produce a valid passport and proof of identity and the necessary VISA applications and confirmations to the Organiser’s satisfaction. If a winner cannot provide proof any of the above to the Organisers’s satisfaction, they automatically forfeit the prize. The ineligible winner will have no claim against the organisers in this event.

 

4.2         Prior to delivering a prize, the Organisers may require the winner to sign an agreement expressly agreeing to the authorisation, indemnity and waiver of liability contemplated in the “Authorisation, Indemnity and Waiver” section below. If a winner will not provide such an authorisation, indemnity and waiver of liability, he/she will automatically forfeit his/her prize, and the winner will have no claim against Organisers.

 

  1. AUTHORISATION, INDEMNITY AND WAIVER

 

5.1       By entering the APA each Entrant acknowledges and agrees to the following, to the extent permitted in law, ‑

 

5.1.1        The organisers, their directors, shareholders, affiliates, partners, employees, agents, consultants, suppliers, contractors and sponsors assume no liability whatsoever for any direct or indirect loss or damage, howsoever arising from or as a result of a subscriber’s participation in the APA or for any loss or damage, howsoever arising, to the subscriber, provided that any such person did not act fraudulently or with gross negligence; and

 

5.1.2        all Entrants and winners indemnify the organisers of APA , any companies associated with either the organisers, as well as the advisers, auditors and advertising, marketing and promotional agencies of the organisers (each, an “Indemnified Party”), and the directors, shareholders, officers, employees and agents of each Indemnified Party, against any and all claims for any costs, expenses, injuries, losses or damages, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever in connection with the Entrants or winner’s, as the case may be, participation in any way whatsoever in APA, provided that the Indemnified Party did not act fraudulently or with gross negligence.

 

5.1.3                The Organisers reserves the right, at any time prior to a Awards, to vary the nature of APA or the prizes or to vary these terms and conditions or to withdraw the APA by reasonable prior notice to the Entrants. In such event, all Entrants hereby waive any rights that they may have against the organisers and hereby acknowledge that, to the extent permitted in law, they will have no recourse or claim of any nature whatsoever against the organisers and any of their respective directors, affiliates, shareholders, partners, employees, agents, consultants, suppliers, contractors and sponsors, provided that any such person did not act fraudulently or with gross negligence.

 

5.1.4        If APA for whatever reason becomes unlawful, the Sponsors will have the right to terminate APA immediately without prior notice to winners or Entrants. In such event, Entrants will be deemed to have waived all rights they may have had and acknowledge and agree that they will have no right of recourse against the Sponsors from any cause whatsoever.
